Special Public Notice: Rock Island District Iowa Regional Permit 40: Fill Material Placed in Water of the United States for Bank Stabilization Activities in the State of Iowa (Reissuance)

TO WHOM IT MAY CONCERN: The U.S Army Corps of Engineers (Corps) Rock Island District has updated and reissued Regional General Permit 40 for bank stabilization activities within Rock Island District in Iowa pursuant to 404 of the Clean Water Act (33 USC 1344) and Section 10 of the Rivers and Harbors Act (33 USC 403).

NOTEWORTHY CHANGES:
1. Updated authorized work limits include updating the maximum impacts language to 2,500 linear feet below the Ordinary High-Water Mark of shoreline.
2. Updated language referencing the Regulatory Request System as the method for applying for a permit.
3. General Condition 3 updated language based on authorized 401 Water Quality Certification: If the project proposes to directly discharge into an Outstanding Iowa Water (OIW) or Outstanding National Resource Water (ONRW), an individual 401 Water Quality Certification (WQC) must be obtained, and the permittee shall not begin work on the activity until an individual 401 WQC is issued by the state or waived. For OIWs or ONRWs that are streams, if the project proposes to discharge into a tributary of an OIW or ONRW, an individual 401 Water Quality Certification (WQC) must be obtained, and the permittee shall not begin work on the activity until an individual 401 WQC is issued by the state or waived.
4. General Restriction 9 now includes reference to the Iowa Excluded Species List.
5. Mitigation now includes updated language if permanent loss of stream greater than 300 linear feet or 0.03-acres.

COMMENTS: This notice is meant to inform the public on the issuance of the updated and reissued Regional Permit for Bank Stabilization in the Rock Island District in Iowa. The Corps is not seeking comments as we have reviewed comments received as a result of the 10 April 2025, public notice. We have addressed and incorporated those comments as appropriate.
