Description
AUTHORITY AND SCOPE
Section 204 of the 1992 Water Resources Development Act, as amended, provides authority for the Corps of Engineers to restore, protect and create aquatic and wetland habitats in connection with construction or maintenance dredging of an authorized navigation project.
CASH CONTRIBUTION
The initial study and all planning costs are 100% federally funded. Design and construction costs above the "Federal Standard" are cost shared 65% Federal and 35% non-Federal. The "Federal Standard" represents the dredging placement work that would have occurred without the proposed 204 project. The sponsor cost share can be a contribution of cash, lands, easements, rights-of-way, relocations, and disposal areas (LERRDs). No work-in-kind is allowed.
LOCAL COOPERATION
Formal assurance of local cooperation must be furnished by a local sponsoring agency. The sponsoring agency must normally agree to the following:
- Provide without cost to the United States all LERRDs necessary for the construction and subsequent maintenance of the project;
- Maintain and operate the project after completion without cost to the United States; and,
- Assume responsibility for all costs in excess of the Federal cost of $10 million.
HOW TO REQUEST ASSISTANCE
Investigations of an environmental improvement project under Section 204 can be initiated upon receipt of a request from a prospective sponsoring agency. Section 204 project requests should be directed to point of contact listed above.
Status
Lee County Conservation Board, Lee County, Iowa received funding and completed a positive Federal Interest Determination (FID). The project is currently developing a feasibility report. The report is expected to be completed in FY 25.

FY 2024: The District worked with Lee County Conservation Board to advance the Feasibility Study. Coordinated with additional communities to identify potential new projects for consideration.
Major Work Item Next Fiscal Year
FY 2025: Completion of the Feasibility Study with the Lee County Conservation Board. If funded for design and construction, work would continue on Lee County Conservation Board project to develop and execute a Project Partnership Agreement and work could begin in FY25. If funded, work with Nahant Marsh Education Center to begin a Feasibility Study. Coordinate with additional communities to identify potential new projects for consideration.
