  • New Regional General Permit 48 Residential Developments in the State of Iowa (CEMVR-RD-2022-0884)

    Expiration date: 8/6/2022

    The U.S. Army Corps of Engineers (Corps) proposes the new Regional General Permit (RP)for the activities required for the construction, expansion, modification, or improvement of residential developments of a single residence, a multiple unit residential development, or a residential subdivision, which result in a total loss of up to 2.0 acre of waters of the United States, including the loss of up to 1,000 linear feet of stream bed. The loss of stream bed plus any other losses of jurisdictional wetlands and waters caused by the activity cannot exceed 2.0 acre, which includes no more than 1,000 linear feet of stream bed loss. Activities may include (but are not limited to) construction of building foundations and building pads and attendant features that are necessary for the use of the residence or residential development. Attendant features include (but are not limited to) roads, parking lots, garages, yards, utility lines, storm water management facilities, septic fields, and recreational facilities such as playgrounds, playing fields, and golf courses (provided the golf course is an integral part of the residential development).

  • County Line Mitigation Bank (CEMVR-RD-2022-0456)

    Expiration date: 7/20/2022

    The bank sponsor proposes to complete activities on 133.7 acres of privately owned property that would result in the establishment of stream, forested wetland, and emergent wetland mitigation credits. Establishment of the Bank will occur in two phases. Phase 1 will involve restoring floodplain wetland function through levee removal and improvement of associated wetlands and buffers in the east portion of the Bank. Phase 2 includes restoring the sediment filled floodplain wetlands and channels in the west portion of the Bank by grading low-lying areas and generating stream credits through the construction of bank protection and buffer establishment along the right descending bank of the Des Moines River. An off-site wetland delineation was completed in January 2021, in accordance with the1987 Wetland Delineation Manual and 2010 Midwest Regional Supplement. The off-site delineation found four potential agricultural wetlands currently used in commodity-crop production and a fifth potential wetland that includes a mix of agricultural and palustrine forested and possibly emergent wetlands. Of the 133.7 acres (52.4 acres west of the BSNF Railroad and 81.3 acres east of the BSNF Railroad) of the Bank, 32.6 acres were preliminarily assessed as either potentially jurisdictional palustrine forested wetland (7.9 acres) and/or agricultural wetland (24.7 acres). An on-site wetland delineation will be completed to help determine current conditions and the determination of credits prior to the submission of the draft mitigation banking instrument.

  • INHF Pearey Mitigation Bank (CEMVR-RD-2022-0757)

    Expiration date: 7/20/2022

    The bank sponsor proposes to complete activities on 180 acres of privately owned property that would result in the establishment of emergent wetland mitigation credits. The goal of the bank is to enhance/create wetlands to generate approximately109 wetland credits. Wetland enhancement/creation will include the following: grading of farmed upland areas, plugging culverts and/or installing stoplog/weir structures to restore hydrology, removal and management of invasive species and seeding with native wetland vegetation. A wetland delineation will be completed in 2022 to help determine current conditions and the determination of credits prior to the submission of the draft mitigation banking instrument.

  • City of Perry, Iowa (CEMVR-RD-2020-610)

    Expiration date: 6/15/2022

    The applicant proposes to expand the Perry Municipal Airport by the relocation and construction of Runway 14/32, 400 feet west, to a length of 4,000 feet and a width of 100 feet. Construction will occur in two phases. Phase 1 will also include a new airfield lighting system consisting of medium intensity runway edge lights, navigational aids, and an electrical vault building. Phase 2 will incorporate a 1,500- foot extension for a Runway 14/32 length of 5,500 feet and converting the existing runway to a full-length taxiway.   • White Fox Mitigation Bank Phase II (CEMVR-RD-2022-0577)

    Expiration date: 5/29/2022

    The bank sponsor proposes to complete activities on 47.6 acres of privately owned property that would result in the establishment of both emergent wetland and stream mitigation credits. One of the goals of this bank is to restore 4,022 linear feet of White Fox Creek to generate an initial estimate of 35,382.16 stream credits. The bank sponsor proposes to use many different in-stream methods to aid in restoring this portion of White Fox Creek, including improving floodplain connectivity, installation of floodplain benches, and restoring stability in highly eroded areas by re-sloping and reshaping the banks and applying bank stabilization if necessary.

  • City of West Des Moines (CEMVR-RD-2021-1061)

    Expiration date: 5/4/2022

    The City of West Des Moines is proposing to construct a new stormwater detention facility along the segment of Blue Creek located north of Interstate 235 between 22nd Street and Valley West Drive. The proposed project is needed to reduce the potential for flooding to streets and nearby residences.   • Buena Vista County Conservation Board (CEMVR-RD-2021-1254)

    Expiration date: 4/15/2022

    The applicant proposes to stabilize existing site conditions and restore recreational opportunities in the Little Sioux River at the Linn Grove Dam after a 2019 flood event breached the earthen south extension of the dam. The newly eroded channel south of the dam and former river channel will be stabilized and partially filled to restore the former dam crest elevation, however the new channel will be maintained as an additional conveyance channel to expand the unit width of the overall structure. A total of 3,980 linear feet of rock bank stabilization (mostly Iowa DOT Class D and some Class B quarry rock revetment) are proposed. Rootwads will be installed at the left descending bank of the new channel for a distance of 203 linear feet at the upstream end, and 100 linear feet at the downstream end where a floodplain channel will be reconnected to the new channel. The rootwads will be collected from the project site where tree removal is unavoidable due to site restoration earthwork.

    The Applicant proposes to construct a new residential development which will include the construction of several roads, sidewalks, grading for new single family and multi-family homes.   • City of West Des Moines (CEMVR-RD-2021-1402)

    Expiration date: 3/29/2022

    Fair Meadows Creek has sustained scour, compromising the stability of the banks and gabion baskets. The Applicant proposes to line the channel of Fair Meadows Creek with revetment and replace two segments of gabion baskets along the stream’s bank. This project will raise the channel’s elevation back to its original profile before the scour occurred. The two segments of gabion baskets that will be repaired have already failed. This project will involve the placement of revetment along 940 linear feet of stream, as well as the removal and reconstruction of 185 linear feet of gabion baskets. As fill material will be placed in greater than 300 linear feet of stream, undergoing a morphological change, compensatory mitigation will be required. A compensatory mitigation plan will be submitted to the Corps. Alternatives, both on-site and off-site will be evaluated to ensure compliance with the 404 B 1 guidelines.

  • City of West Des Moines (CEMVR-RD-2021-1673)

    Expiration date: 3/25/2022

    The applicant is proposing to expand Stagecoach Drive to the Southwest. The purpose of this project is to extend Stagecoach Drive between South Jordan Creek Parkway and the future extension of South 81st Street. The project is needed to provide roadway and utility infrastructure, eventually extending Stagecoach Drive to South 88th Street. There are two existing tributaries (Unnamed Tributaries to the Raccoon River) located within the proposed road extension area. The applicant is proposing to grade and fill portions of these tributaries as part of the proposed extension. A wetland delineation was completed by Foth on August 11, 2021, identifying 2,800 linear feet of perennial stream, 2,190 feet of erosional/drainage features, .05 acres of pond and 1.08 acres of wetland.

  • Concise Earth (CEMVR-RD-2022-43)

    Expiration date: 4/6/2022

    The applicant proposes to construct a new 138-acre residential development, Marion AircomPark, south of Cedar Rapids. A road crossing to the north of the existing impoundment is proposed to permanently impact 0.40 acres of emergent wetland, Area 1. The applicant has stated that the impoundment would be drained, and the previously inundated wetlands are expected to re-establish. The Corps considers the draining of these wetlands a conversion from one type of water to another, which would result in a loss of aquatic resources. The wetlands in Area 5 measure 5.74 acres. It is not clear from the drawings provided how large the impoundment is or what will be permanently impacted (Area 2 and/or Area 5) but this will be required to be provided prior to final permit issuance to determine applicable compensatory mitigation.

  • Special Public Notice for the Nationwide Permit Issuance, Reissuance, Regional Conditions, Water Quality Certification, for the State of Iowa

    On December 27, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 41 NWPs will go into effect on February 25, 2022, and they will expire on March 14, 2026: (see full notice below for list).

  • Watts Group Construction (CEMVR-RD-2021-1265)

    Expiration date: 3/2/2022

    The applicant proposes to construct a new 104-acre residential subdivision, Trail Ridge Estates, outside of Solon, Iowa. The applicant submitted an application for review on August 25, 2021, and while the project was in review the unauthorized discharge of fill material into waters of the United States (WUS) occurred. A notice of violation was issued on November 23, 2021. At this time, no additional discharge of fill material has occurred within the identified wetlands. Should additional fill occur prior to a final Corps permit being issued this project will likely to be referred to the United States Environmental Protection Agency.

  • Jones County Secondary Roads (CEMVR-RD-2021-1671)

    Expiration date: 2/5/2022

    The applicant proposes to construct a new 454’, 3-span, 15-degree skew BTE beam bridge crossing of Landis Road over the Wapsipinicon (Wapsi) River southeast of Anamosa, Iowa. The new bridge would be approximately 900 feet downstream of the existing bridge. The existing bridge will be abandoned in place. The project also consists of the placement of approach road embankment fill, revetment stone for bank armoring, and shaping of the stream channel banks to transition to the new structure opening. The wetland delineation report identified one 1.6-acre farmed wetland on east side of the Wapsi. The project is expected to permanently impact 1.41 acres of this farmed wetland with grading and fill. An additional 0.10 acres within the right-of-way may be temporarily disturbed during construction, but the ground surface elevations will remain the same such that continued wetland conditions can exist after construction. The applicant is proposing to purchase wetland credits for compensatory mitigation for permanent wetland impacts.

  • Iowa Department of Transportation (CEMVR-OD-P-2017-335)

    Expiration date: 1/19/2022

    This permit for the original project expired December 31, 2020. The Iowa Department of Transportation (IA DOT) is re-applying for the same permit for the purposes of obtaining a new permit that will allow them to complete the entire project. All of the impacts that were planned for in the original permit have been accounted for through the compensatory mitigation plan in the original permit. No additional mitigation will be required. The work described below was within the original permit, but it was not completed, and the IA DOT did not request an extension of time prior to the permit expiration.

  • City of Des Moines (CEMVR-RD-2021-1434)

    Expiration date: 1/5/2022

    The Applicant proposes to construct a small flood control facility to reduce the frequency and duration of flooding events for the local area by replacing the existing infrastructure and limiting peak flow rates by providing regional flood control at this location. Specifically, this project will include replacing the existing wood structure culverts and storm sewer system with RCP and concrete box culverts. The outfall of this structure will discharge into 8' flat bottom channel with 4:1 side slope. This site will consist of construction of a detention basin constructed by enlarging and dredging adjacent to an existing V-bottom channel. It will aide in the reduction of bank erosion and channel stability and to provide additional storage during large rainfall events. Bank armoring will be implemented through the cut-banks of the channel improvements to prevent erosion and improve water quality. This will include Class "D" Rip-Rap and geo-grid material. The proposed detention cell will have an outlet structure that provides a pre-development release rates and will aide in the reduction of the overall peak flow rates. The detention basin will be seeded with wetland vegetation.

  • City of Cincinnati, Iowa (CEMVR-RD-2021-1310)

    Expiration date: 12/15/2021

    The Applicant proposes to upgrade and improve an existing wastewater treatment plant that serves the City of Cincinnati, Iowa. This proposal includes the following: The existing lagoon infrastructure for primary and secondary treatment will be retained and a 4-cell aerated Horizontal Flow SAGR will be constructed south of the existing facility. Ultra-violet (UV) disinfection for treatment of E.coli is planned for construction at the same location. A waterway will be constructed from the east and a 1.4-acre pond will be built on a small tributary coming from the south. As a result of this project, 1.38 acres of wetland (0.25 forested and 1.13 emergent) would be filled and a yet to be determined amount of stream will be impounded behind the earthen embankment. This project has received a Categorical Exclusion from the USDA Office of Rural Development.

  • Shadow Creek V & VI, LLC (CEMVR-OD-P-2020-148-1)

    Expiration date: 12/15/2021

    In 2020, the Applicant was issued a DA Permit to impact 1.44 acres of emergent wetland, 0.04 acres of forested wetlands, 481 linear feet of intermittent streams and 129 linear feet of perennial streams. The impacts were for the development of a new residential subdivision that included tree removal, mass grading, utility installation, road construction and the installation of two storm water detention basins. The project is currently underway and the required compensatory wetland and stream mitigation has been completed. The purpose of this public notice is to solicit comments to modify the permit to include an additional 0.31 acres of wetland, 634 linear feet of perennial stream and 185 linear feet of ephemeral stream. These impacts are for additional impacts as part of the expansion of the permitted subdivision. Impacts will include streets, grading for homes and additional utilities. In addition to these impacts, the Applicant self-reported 190 linear feet of perennial impacts to a portion of a stream from the previously permitted area.

  • Double Eagle Golf, Inc (CEMVR-OD-P-2020-1477)

    Expiration date: 12/1/2021

    The applicant proposes to construct an earthen dam and a pond to provide irrigation to the golf course. Impacts to Waters of the U.S., will occur through the construction of the dam, and inundation and conversion of a stream to a pond. Specifically, this project will involve the loss of approximately 1800 linear feet of perennial stream.

  • Delaware County Wetland Mitigation Bank (CEMVR-RD-2021-1429)

    Expiration date: 12/1/2021

    The bank sponsor proposes to complete activities on 41.3 acres of privately owned property that would result in the establishment of both forested and emergent wetland mitigation credits. The goal of the bank is to enhance/create wetlands to generate approximately 24 wetland credits.

  • Red Haw Lake (CEMVR-RD-2021-1366)

    Expiration date: 11/12/2021

    The applicant proposes to stabilize the bank of Red Haw Lake by placing rock armoring along the shoreline at four locations for a total distance of 3,680 linear feet; Site 1 = 760 linear feet, Site 2 = 660 linear feet, Site 3 = 760 linear feet, and Site 4 = 1,500 linear feet. Most of the riprap is new and will be placed along the shoreline on a 2:1 slope. The riprap will be 2 feet thick and 5 feet high, with 3 feet below pool elevation and 2 feet above pool elevation. No bank reshaping is required as the shoreline is already at a 2:1 slope. All disturbed areas will be seeded, mulched, and fertilized. The replacement of a deteriorated water control structure is also proposed at the inlet to Red Haw Lake, which is located at the southeastern end of the Lake. The applicant has stated there are no impacts on existing wetlands, no borrow areas, stockpile and staging will occur in existing gravel parking lots, there will be no tree clearing, and existing trees will be preserved and worked around with small equipment. The purpose of this project is to stabilize the shoreline of Red Haw Lake and replace the deteriorating water control structure.

  • Clear Creek Stream Mitigation Bank (CEMVR-RD-2021-0792)

    Expiration date: 11/13/2021

    The bank sponsor proposes to complete activities on city owned property along Clear Creek in Coralville, Iowa that would result in the establishment of stream mitigation credits. The goal of the bank is to restore 6,565 linear feet of two separate reaches of Clear Creek and 2,238 linear feet of Becky’s Creek to generate an initial estimate of 97,781 stream credits.

  • Osceola County Rural Water System, Inc (CEMVR-RD-2021-0918)

    Expiration date: 9/29/2021

    The applicant proposes to construct a low head dam / rock riffle structure within the channel of the Ocheyedan River. An estimated 0.05 acres of riverbed will be filled as a result and the applicant plans to allow water to flow over the top of the dam structure.
